The description and any specific license terms provided on an individual product page form part of the terms applicable to that purchase.

We reserve the right to add, modify, update or discontinue products or services, subject to applicable law and any applicable access rights associated with purchases already made.

SECTION 3 – DIGITAL PRODUCTS AND LICENSE TO USE

Unless expressly stated otherwise on an individual product page, purchasing a digital product from Von Baron Music does not transfer ownership of the product, its underlying content, or any copyright or other intellectual property contained within it.

Instead, your purchase grants you a limited, personal, non-exclusive and non-transferable license to access and use the purchased product in accordance with these Terms.

For courses, lesson packs, interactive practice apps, e-books and educational materials, this license is for the purchaser’s personal educational and practice use unless a different license is expressly provided.

You are purchasing the right to access or use the content. You are not purchasing ownership of the copyrighted content itself.

All rights not expressly granted to you remain reserved by Von Baron Music and/or the applicable rights holder.

SECTION 4 – ONLINE COURSES AND LESSON PACKS

Access to online courses and lesson packs is provided to the individual purchaser and may be associated with that purchaser’s customer account.

Your purchase grants you the right to personally view, study and practice with the purchased course materials.

It does not grant you ownership of the course videos, audio, text, graphics, PDFs, exercises, charts, demonstrations or other copyrighted course content.

Unless expressly authorized in writing by Von Baron Music, you may not:

Share your course access with another person
Allow another person to use your account to access purchased courses
Share your login credentials
Sell, transfer, sublicense, rent, lend or give away course access
Copy, reproduce or redistribute course videos
Screen-record or otherwise record course videos
Upload protected course content to another website, social media platform, cloud storage service, file-sharing service or other location for distribution
Reproduce or distribute course PDFs, charts, exercises or other materials to other people
Publicly display or perform protected course content except as expressly permitted
Use substantial portions of our copyrighted course materials to create or distribute a copied or derivative commercial educational product

Course access is intended for one individual purchaser unless Von Baron Music expressly agrees otherwise in writing.

SECTION 5 – INTERACTIVE DRUM PRACTICE APPS AND TOOLS

Purchasing access to an interactive drum practice app or practice tool grants the purchaser a personal, non-exclusive and non-transferable right to use that app or tool according to the terms of the applicable purchase.

You may use the apps and practice tools for your own musical practice and education.

Unless expressly authorized by Von Baron Music, you may not:

Share your account or app access with another person
Provide another person with login credentials, protected links, passwords or other information for the purpose of obtaining unauthorized access
Sell, transfer, sublicense or redistribute access
Copy or reproduce the software or underlying code
Attempt to reverse engineer, extract or circumvent the security or access-control mechanisms of an app, except to the extent such restriction is prohibited by applicable law
Host, copy or reproduce our apps or tools on another website or service
Modify or create unauthorized derivative versions of the software

Interactive products may depend on compatible browsers, devices, microphones, speakers, headphones, audio hardware, internet connections or other technology.

While we make reasonable efforts to support commonly used systems, we cannot guarantee compatibility with every device, operating system, browser or hardware configuration.

SECTION 6 – DOWNLOADABLE DRUM TRACKS, PRACTICE TRACKS AND AUDIO PRODUCTS

Von Baron Music may sell downloadable drum tracks, drumless tracks, backing tracks, play-along tracks, practice tracks and other audio recordings.

The permitted use of a track depends upon the license stated on the applicable product page.

Unless a broader license is expressly provided, purchasing a track grants you a personal, non-exclusive and non-transferable license to download and use the track for your own listening, musical practice and education.

Some products may expressly include permission for use in recordings, videos, performances, multimedia productions or other creative projects. When such permission is stated on the applicable product page, you may use the track within the scope of that stated license.

Unless expressly permitted by the applicable product license, you may not:

Resell or redistribute the original audio file
Share purchased audio files with other people
Upload the original track for others to download
Sell or sublicense the track itself as a standalone product
Claim authorship or ownership of the original recording
Include the original track in a sample library, backing-track collection, stock-music library or substantially similar competing product
Make the original track available through file-sharing networks or services

Purchasing a track does not transfer copyright ownership of the underlying recording or composition.

If an individual product page provides a specific commercial, production or multimedia license, that license controls with respect to the uses expressly authorized by that license.

SECTION 7 – E-BOOKS, PDFs, CHARTS AND DOWNLOADABLE EDUCATIONAL MATERIALS

Purchasing an e-book, PDF, chart, exercise or other downloadable educational material grants you a personal, non-exclusive and non-transferable license to use that material for your own education and practice unless otherwise expressly stated.

You may download and store purchased materials on your personal devices and may print reasonable copies for your own personal use.

Unless expressly authorized by Von Baron Music, you may not distribute copies to students, colleagues, friends, schools, organizations or other third parties.

You may not upload, publish, resell, sublicense, reproduce for distribution or otherwise make purchased materials available to other people.

SECTION 8 – VIDEO EXCHANGE DRUM LESSONS

Video Exchange Drum Lessons are educational services in which a customer may submit video, audio, questions or other materials for review and receive personalized educational feedback from Von Baron Music.

The exact format, scope, submission requirements and deliverables will be described on the applicable product page.

Customers are responsible for ensuring that materials they submit are their own or that they have the necessary permission to submit those materials.

By submitting material for a Video Exchange Drum Lesson, you grant Von Baron Music a limited license to access, view, store and use the submitted material as reasonably necessary to provide the purchased lesson and related customer support.

You retain ownership of your original submitted material.

Unless you separately provide permission, purchasing or participating in a Video Exchange Drum Lesson does not grant Von Baron Music permission to publicly publish your private lesson submission for advertising, social media or other promotional purposes.

Educational feedback represents instructional guidance. Von Baron Music does not guarantee any particular level of musical improvement, performance outcome, professional opportunity or other result.

SECTION 9 – CUSTOMER ACCOUNTS AND ACCESS

Certain products require a customer account.

You are responsible for providing accurate account information and maintaining the confidentiality of your login credentials.

Your account is intended for your individual use.

You may not permit another person to use your account to access products that person has not purchased or otherwise been authorized to access.

If you believe your account has been compromised or accessed without your authorization, please contact Von Baron Music so that we can assist you.

We may take reasonable technical or administrative measures to prevent unauthorized account sharing, redistribution or access.

If we reasonably determine that an account is being used to provide unauthorized access to our products, we may suspend or terminate access, subject to applicable law.

SECTION 10 – LIFETIME ACCESS

Certain products may be advertised as providing lifetime access.

Unless otherwise expressly stated, “lifetime access” means that the purchaser may continue accessing the purchased digital product for as long as Von Baron Music continues to make that product, or substantially equivalent purchased content, available through the Service.

Lifetime access does not guarantee that a particular website, URL, hosting provider, ecommerce platform, software platform, application, file format, app interface or other technology will remain unchanged or available indefinitely.

Von Baron Music may migrate, reorganize, redesign, update or replace the technology used to deliver purchased content.

Where reasonably possible, we will seek to preserve applicable customer access when migrating purchased content to a different delivery system.

“Lifetime access” does not constitute a guarantee that Von Baron Music, any individual associated with Von Baron Music, or any particular website, platform, technology or third-party service will continue operating indefinitely.

SECTION 11 – COPYRIGHT AND INTELLECTUAL PROPERTY

Unless otherwise indicated, content available through Von Baron Music, including videos, audio recordings, courses, lessons, interactive apps, software, text, graphics, photographs, PDFs, charts, exercises, e-books, educational materials and other original content, is owned by or licensed to Von Baron Music and is protected by applicable copyright and intellectual property laws.

Purchasing a product does not transfer copyright or other ownership rights to you.

Except for the limited rights expressly granted under these Terms or on an applicable product page, you may not reproduce, duplicate, copy, distribute, sell, resell, sublicense, publish, upload, transmit or commercially exploit our copyrighted materials without prior written permission.

Unauthorized copying, sharing or distribution may result in suspension or termination of access and may constitute infringement of intellectual property rights.

SECTION 12 – ACCOUNT, PASSWORD AND ACCESS SHARING

Purchased courses, apps and other account-based digital products are licensed to the individual purchaser.

You may not share, transfer, sell, publish or give another person:

Your customer account
Your login credentials
Protected passwords
Protected access links intended to bypass account controls
Copies of purchased course content
Copies of purchased e-books, PDFs or educational downloads
Purchased audio files except as expressly permitted by the applicable track license

If you wish to purchase a product as a gift or require access for multiple people, please contact Von Baron Music regarding appropriate arrangements or licensing.

SECTION 13 – DIGITAL DELIVERY

Digital products may be delivered through customer-account access, protected web pages, download links, email or other electronic methods.

You are responsible for providing a valid email address and maintaining access to the email account associated with your purchase.

For account-based digital products, access is generally provided after successful payment has been confirmed.

For downloadable products, delivery occurs when the purchased file or download link is made available following successful payment.

If you experience difficulty accessing a product you purchased, please contact Von Baron Music so that we can assist you.

SECTION 14 – PRICES, ORDERS AND PAYMENT

Prices for products and services are displayed on the applicable product pages and may change without notice.

A price change will not retroactively change the price of a previously completed purchase.

Payment must be successfully authorized before access to paid digital products is granted.

We may use third-party payment processors to process transactions. Payment information submitted through those services may be subject to the applicable payment provider’s terms and privacy practices.

We reserve the right to refuse or cancel an order where reasonably necessary, including in cases involving suspected fraud, unauthorized payment, obvious pricing errors or material violations of these Terms, subject to applicable law.

SECTION 15 – REFUNDS, RETURNS FOR DIGITAL PRODUCTS AND SERVICES

Certain products are offered with a 2-Day Money-Back Period. For eligible products, customers may request a refund within 48 hours of the date and time of payment. After this 48-hour period has expired, all sales are final and non-refundable.

All other individual courses, digital downloads, interactive tools, and digitally delivered products or services are final and non-refundable at the time of purchase, unless otherwise stated on the applicable product page, provided for in the Von Baron Music Refunds and Returns Policy, or required by applicable law.

Because products and services sold by Von Baron Music may include digital content, downloadable materials, online educational content, interactive tools, and digitally delivered services, refunds, returns, and exchanges are generally not available once a purchase has become final.

This includes, but is not limited to:

Online drum courses and lesson packs after any applicable 2-Day Money-Back Period
Interactive drum practice apps and practice tools
Drum tracks, drumless tracks, backing tracks, play-along tracks, and practice tracks
E-books
PDFs, charts, and other downloadable educational materials
Video Exchange Drum Lessons
Other digital products and digitally delivered services

Customers are responsible for reviewing product descriptions, included content, compatibility requirements, access terms, and other information provided on the applicable product page before completing a purchase.

A customer’s decision not to use, complete, download, or access a purchased product does not entitle the customer to a refund.

For products requiring an online account, digital access is considered provided when the purchased content is made available through the customer’s account following successful payment. For downloadable products, delivery is considered provided when the applicable files or download links are made available following successful payment.

Video Exchange Drum Lessons are non-refundable once the purchase has been completed. If Von Baron Music is unable to provide a purchased Video Exchange Drum Lesson, an appropriate remedy may be provided, including rescheduling, replacement service, store credit, or a refund where appropriate or required by applicable law.

Technical difficulties accessing a product do not automatically entitle a customer to a refund. Customers experiencing access or technical problems should contact Von Baron Music so that reasonable efforts can be made to resolve the issue.

Nothing in these Terms excludes, restricts, or modifies any consumer right or remedy that cannot lawfully be excluded, restricted, or modified under applicable law.

SECTION 16 – BILLING AND ACCOUNT INFORMATION

You agree to provide current, complete and accurate purchase and account information.

You agree to update relevant information, including your email address, when necessary so that we can provide access to your purchases and contact you regarding your account or orders.

We may limit or cancel orders that reasonably appear to involve fraud, unauthorized resale, abuse of promotional offers or other improper activity.

SECTION 17 – PRODUCT INFORMATION, MODIFICATIONS AND AVAILABILITY

We make reasonable efforts to accurately describe our products and services.

Course content, lesson organization, app interfaces, exercises, downloadable materials and other digital products may be updated, expanded, reorganized or improved over time.

Screenshots, demonstrations and descriptions may therefore differ somewhat from the current version of a product.

Prices for products may change without notice.

We reserve the right to modify or discontinue products offered for future purchase.

Nothing in this section eliminates applicable access rights associated with purchases already made, except as otherwise provided by these Terms or applicable law.

SECTION 18 – EDUCATIONAL RESULTS

Von Baron Music’s courses, apps, lessons, practice materials and other educational products are designed to assist with musical education and practice.

Individual results vary depending on factors including practice, experience, ability, equipment, time invested and individual circumstances.

We do not guarantee specific improvements, professional results, employment, performance opportunities, income or other outcomes from using our educational products or services.

SECTION 19 – THIRD-PARTY SERVICES, TOOLS AND LINKS

Our Service may use, integrate with or link to third-party websites, payment processors, hosting providers, software, video services, ecommerce technologies or other services.

We do not control independent third-party services and cannot guarantee their availability or continued operation.

Use of third-party services may be subject to their own terms, privacy policies and technical requirements.

We may change third-party providers or technologies used to operate or deliver the Service when reasonably necessary.

Third-party links may direct you to websites not controlled by Von Baron Music. We are not responsible for the content, policies or practices of independent third-party websites.

SECTION 20 – USER SUBMISSIONS, COMMENTS AND FEEDBACK

If you voluntarily provide reviews, comments, suggestions or feedback concerning our products or Service, you grant Von Baron Music permission to use that feedback for legitimate business purposes, including improving our products and, where appropriate, displaying customer reviews.

You remain responsible for content you submit.

You may not submit material that infringes another person’s rights, contains malicious software, is unlawful, defamatory, abusive, intentionally false or misleading, or otherwise violates applicable law.

This section does not override the more limited rights granted to Von Baron Music concerning private materials submitted as part of a Video Exchange Drum Lesson.

SECTION 21 – PERSONAL INFORMATION AND PRIVACY

Our collection and use of personal information is governed by our Privacy Policy and applicable law.

Customers should review our Privacy Policy for information regarding how personal information is collected, used, stored and handled.

SECTION 22 – PROHIBITED USES

In addition to other restrictions contained in these Terms, you may not use our website, products or Service:

(a) for an unlawful purpose;

(b) to violate applicable laws or regulations;

(d) to distribute malicious software or interfere with the operation or security of the Service;

(e) to obtain unauthorized access to another person’s account;

(f) to circumvent access restrictions, membership controls or security measures;

(g) to scrape, systematically copy or extract protected content without authorization;

(h) to share, redistribute or resell digital products contrary to the license applicable to those products;

(i) to impersonate another person or provide materially false information for fraudulent purposes;

(j) to share accounts or credentials for the purpose of providing unauthorized access to paid content; or

(k) to otherwise use the Service in a manner that materially violates these Terms.

We may suspend or terminate access for material violations of these restrictions, subject to applicable law.

SECTION 23 – ERRORS, INACCURACIES AND OMISSIONS

Occasionally, information on our website may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, availability or other information.

We reserve the right to correct errors, inaccuracies or omissions and to update information when appropriate.

We will make reasonable efforts to maintain our digital products and resolve problems within our control, but we cannot guarantee uninterrupted availability of third-party systems or compatibility with every possible hardware and software configuration.

Nothing in these Terms excludes warranties, guarantees or consumer protections that cannot legally be excluded.

SECTION 25 – LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Von Baron Music and its owners, employees, contractors, affiliates, service providers and licensors will not be liable for indirect, incidental, special, punitive or consequential damages arising from use of, or inability to use, the Service or products.

Where applicable law does not permit certain exclusions or limitations of liability, those exclusions or limitations will apply only to the maximum extent permitted by law.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

SECTION 26 – INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless Von Baron Music and its owners, employees, contractors, affiliates and service providers from third-party claims arising from your unlawful use of the Service, infringement of another person’s rights, or material breach of these Terms.

These Terms remain effective while you use the Service or maintain access to products provided through the Service.

Sharing login credentials
Unauthorized redistribution or resale
Copying or distributing protected content
Copyright or other intellectual property infringement
Fraudulent activity
Attempts to circumvent account or access controls

Where appropriate, we may first contact the customer regarding suspected unauthorized activity.

Termination or suspension resulting from a material violation of these Terms does not entitle the customer to a refund, except where required by applicable law.

Provisions concerning intellectual property, licensing, liability and other provisions that by their nature should survive termination will remain effective.

SECTION 28 – SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law and, where necessary, severed from these Terms.

The remaining provisions will continue in effect.

If a product-specific license expressly grants rights broader than these general Terms, the product-specific license will control with respect to those expressly granted rights.

Our failure to exercise or enforce a right or provision of these Terms does not constitute a waiver of that right or provision.
